COURT WATCH OKLAHOMA UPDATE

 

The mission statement of ABATE of Oklahoma is to promote and defend motorcyclists’ freedom, safety and awareness through education and legislation to make Oklahoma the best place to ride!

Out of a great need, a movement was born. In 2017, a member of ABATE of Oklahoma was contacted by a concerned citizen inquiring if we could lend support to the family of a victim killed in a motorcycle crash. The young victim was hit and killed by the driver of an automobile and the driver was facing criminal prosecution. Members of ABATE of Oklahoma and other community-minded riding associations wrote over 200 letters to the District Attorney requesting that justice be served, and the defendant not be allowed to negotiate a plea to lesser charges. We proudly and respectfully attended the pre-trial conference, subsequent change of plea hearing (where the defendant plead guilty to all charges) and the sentencing hearing. Since that time, the “Court Watch Oklahoma Team” has lent support to other families facing similar tragedies. We spend significant time contacting the respective police departments and district attorneys to determine why multiple cases have not proceeded. The results have been positive.

 

It is not our intention to influence the prosecution of a case; we simply want it to be known that the motorcycling community is watching cases involving the alleged negligent injury or death of a motorcyclist.

 

The Court Watch Oklahoma Team is currently tracking the following court cases pending in Oklahoma. Criminal charges were filed, by the respective District Attorney, in cases where a driver is charged with causing serious injury or death to a motorcyclist. *



CF-2023-69, State v. Abbas
Count 1: Manslaughter, First degree
Count 2: Fail to Yield from Yield Sign
Motorcyclist killed, Defendant in custody, Bond set at $500,000
Blind Plea of No Contest entered 2/26/2024
 A previous case is trailing the new felony case: CM-2022-358 (Kay County)
Count 1: Actual Physical Control of a MV While Under Influence

IT IS THE ORDER OF THE COURT THAT IN:
  - CF-23-69 COUNT 1 DEFT IS SENTENCED TO 20 YEARS DOC. HOWEVER AFTER SERVING 10 YEARS DOC THE REMAINING BALANCE BE SUSPENDED UPON THE FOLLOWING CONDITIONS. DEFT IS TO COMMIT NO FURTHER LAW VIOLATIONS, BE UNDER DOC SUPERVISION FOR A PERIOD OF 2 YEARS. COMPLY WITH 991A FEES FOR A PERIOD OF 2 YEARS, COMPLETE DRUG AND ALCOHOL PROGRAMS WHILE INCARCERATED, COMPLETE MENTAL HEALTH PROGRAMS, SUBMIT DNA AND PAY ALL SUMS ASSESSED. DEFT IS ASSESSED A FINE OF $500, A VCA OF $250, AN OIDS FEE OF $250, COURT COSTS AND COST OF INCARCERATION.
- IN COUNT 2 OF CF-23-69 DEFT IS SENTENCED TO 10 DAYS KCDC. DEFT IS ASSESSED A FINE OF $100, A VCA OF $150, COURT COSTS AND COSTS OF INCARCERATION.
- IN CM-22-358 DEFT IS SENTENCED TO 1 YEAR KCDC WITH CREDIT FOR TIME SERVED. DEFT IS ASSESSED A FINE OF $300, A VCA OF $100, A DMH FEE OF $100, AN OIDS FEE OF $150, COURT COSTS AND COSTS OF INCARCERATION. COURT ORDERS ALL CASES AND COUNTS TO RUN CONCURRENT. DUE TO DEFT'S INDIGENCY COURT CAPPS INCARCERATION IN THE AMOUNT OF $1000. DEFT IS ADVISED OF HER RIGHT TO APPEAL AND IS ORDERED TO THE COST ADMINISTRATOR WITHIN 180 DAYS OF RELEASE FROM DOC. DEFT WAIVES 10 DAYS FOR TRANSPORT.

The Court Watch Oklahoma Team monitors court cases and communicates with the District Attorneys’ offices to let them know that the motorcycling community is watching and urging the District Attorney not to engage in plea negotiations to lesser charges.
